Provisional Justice? The ICJ Order in the South Africa v Israel Genocide Case

Since 7 October 2023, the world’s horror at the atrocities committed by Hamas in Israel has expanded to include widespread debate about the nature of Israel’s response against the population of Gaza. On 29 December 2023, South Africa lodged a claim in the International Court of Justice alleging that Israel’s response included genocidal acts in violation of the Genocide Convention. On 24 January 2024, the International Court of Justice issues its decision on South Africa’s request for provisional measures. South Africa requested the Court to indicate provisional measures in order to ‘protect against further, severe and irreparable harm to the rights of the Palestinian people under the Genocide Convention’ and ’to ensure Israel’s compliance with its obligations under the Genocide Convention not to engage in genocide, and to prevent and to punish genocide’. This event is intended to provide the opportunity for a discussion in the LSE community about the international legal nature, circumstances and implications of the Order handed down by the Court, led by members of LSE’s international law team.
