He then worked “in house at a major law firm\, running a national Health Law practice and returned to the Bar in 2008. He took silk in 2011 and is lead author of NHS Law and Practice\, the leading practitioner’s guide to the NHS. He has been in a series of major cases about medical law and ethics and sits as a part time Judge\, as well as providing advice to governments. He co-led Haleon’s historic de-merger from GSK\, the largest spin-off and listing in modern UK history\, and he spearheaded the transformation of its +200 person legal\, compliance\, and security organizations. As CLO and GC at Pearson\, a FTSE 100\, Bjarne transformed a +200 person legal team and drove a widely acclaimed digital transformation of its legal services model. SUMMARY:'Privacy's Revival'\, by Dr Gauri Pillai
DESCRIPTION:Dr Pillai will present Chapter 1 (Privacy’s Revival) of her monograph tentatively titled ‘The Synthesis Paradigm: Constitutional Reproductive Rights in India’. \nReproductive rights are deeply contested. Their scope within constitutions\, the duties they impose on States\, and their response to competing State priorities are being urgently deliberated. To arrive at answers\, a prior enquiry must be addressed\, one invoking first principles. Are reproductive rights better understood as incidents of one’s privacy or equality? Depending on the alternative chosen\, the scope\, the duties and the limits of reproductive rights vary. Constitutional law leans heavily towards privacy. Yet\, privacy has been subject to scathing critique. Where equality is introduced\, especially in response to privacy’s failures\, a choice is typically constructed between equality or privacy. At best\, constitutional law offers an additive option: both equality and privacy as driving reproductive rights protection. Cutting cleanly through this contestation\, based on an in-depth study of the Indian Constitution\, the monograph proposes a novel ‘constitutional home’ for reproductive rights: the ‘synthesis’ between privacy and equality. As opposed to mere rights combination or addition\, the ‘synthesis’ fosters dynamic rights interaction. Chapter 1 makes a compelling argument about why\, despite its critiques\, privacy must be retained within the ‘constitutional home’ for reproductive rights in India. \nSpeaker: Dr Gauri Pillai \nDr Gauri Pillai is a Max Weber Post-Doctoral Fellow at the European University Institute\, Florence. Her work studies reproductive rights and constitutionalism\, with a specific focus on India and the Global South. As Assistant Professor\, she taught Constitutional Law and Family Law at the National Law School of India University Bangalore. She holds the Doctor of Philosophy in Law and the Bachelor of Civil Law from the University of Oxford\, and the BA LLB (Hons.) from the West Bengal National University of Juridical Sciences. Her work has been supported by the Rhodes Scholarship and the Alaine Locke Studentship. During her career Steph focused primarily on corporate advisory matters and\, as Technical Head of Listed Companies at Freshfields\, advised the firm’s FTSE 100 and FTSE 250 clients on disclosure obligations\, the continuing obligations regime\, company law and corporate governance. DESCRIPTION:A lecture during November/December for the “16 Days of Action Against Domestic Violence” on Nath’s involvement in the cases of Transnational Marriage Abandonment discussing the ways in which borders/immigration law facilitated domestic abuse. \nNath is an immigration solicitor at Leigh Day Solicitors\, and a Visiting Fellow in Practice at LSE. Nath’s practice covers a wide range of immigration\, asylum and nationality law\, with particular emphasis on human rights applications. \nNath previously volunteered for Queen Mary Legal Advice Centre and Rainbow Migration\, and served as a board member of the Joint Council for the Welfare of Immigrants (JCWI). Nath also writes regularly for the reputable Free Movement blog\, including case law updates\, briefings and training courses. \nNath is an active member of the Immigration Law Practitioners Association (ILPA). DESCRIPTION:   Register for the event \nThe Global Financial Crisis 15 Years On: Insights into Central Counterparties’ Responses to Member Defaults \nMarking 15 years since the nadir of the global financial crisis\, this seminar is part of a series exploring the events of 2008 and drawing out insights for current debates. \nCentral Counterparties (CCPs)\, a type of financial market infrastructure\, respond differently to member defaults depending on (among other factors) the nature of the default\, market conditions\, and the potential impact on public customers. Their responses in past situations are important data points in evaluating regulatory regimes that might apply in the event of a CCP member default. The discussion will feature a review and analysis of the actions taken by key CCPs in the wake of high-profile defaults in the Lehman and MF Global cases\, including a review of the public customer account porting process and the portfolio auctions.  The discussion will also touch upon other member default situations and CCP reactions in those cases. \nThis event will be of interest to those with an interest in financial and insolvency law\, financial market infrastructure\, market regulation\, and banking law. Students are warmly encouraged to join.  \nSpeaker: Vincent E. Lazar \n \nVince Lazar is co-chair of Jenner & Block’s Bankruptcy Litigation and Markets & Trading practices. Drawing upon his bankruptcy and restructuring expertise\, Vince regularly advises clearing organizations\, self-regulatory organizations and market participants concerning member default issues\, customer protection concerns and crypto and fintech proposals. \nVince has played a leading role in a number of financial services sector insolvency cases and is considered an expert on commodity broker bankruptcy cases. He represented the CME Group in the SIPA liquidation proceeding of MF Global\, including implementation of its unprecedented transfer of under-margined positions to other commodity brokers; the examiner in Lehman Brothers; both the National Futures Association and CME Group in Peregrine Financial Group’s case; the bankruptcy trustees in Stotler & Company and Refco\, LLC\, where he acted as the trustee’s special counsel in the first-ever successful bankruptcy sale of a commodity broker business; and trustee of Sentinel Management Group\,  a $1 billion+ fraud case involving the misuse of segregated customer assets. DESCRIPTION:On Tuesday\,  24th October 2023\, at 6.30 pm\, international lawyers from the LSE Law School will discuss the latest phases of the war in Ukraine with particular attention to the various international legal responses (neutrality\, war crimes\, secession\, sanctions) currently being mooted or enacted. \nWe will have three speakers for this event: Gerry Simpson\, Lora Izvorova and Oliver Hailes. \nGerry Simpson\, Professor of Public International Law \nGerry Simpson is Professor of International Law at LSE. His latest work\, The Sentimental Life of International Law: Literature\, Language and Longing in World Politics\, was published by Oxford University Press in late 2021. He is currently writing a study of the Cold War (with Sundhya Pahuja at the University of Melbourne) as well as The Atomics\, a philosophical memoir. \nLora Izvorova\, LSE Fellow \nLora Izvorova is a Fellow in Law at the LSE Law School. Her most recent research focuses on Russia’s compliance with international human rights norms and the relationship between Russia and the Council of Europe\, from which Russia was expelled in March 2022 as a consequence of its invasion of Ukraine. \nOliver Hailes\, Assistant Professor of Law \nOliver Hailes is an Assistant Professor at the LSE Law School. Recent work has focused on reconciling investment arbitration and climate change by integrating rules from environmental law. DESCRIPTION:Speaker: Professor Jens Hinrich Binder (LSE Law School Visiting Professor)\nChair: Professor Jo Braithwaite (LSE) \nFocusing on the European perspective\, this talk explores company directors’ duties in the context of the debate about promoting environmental and social (ESG) interests. It argues that\, in contrast to traditional\, shareholder-oriented concepts of directors’ duties\, new stakeholder-oriented obligations have been established\, inter alia\, by new European legislation rooted in international standards. While far more detailed and prescriptive than traditional duties\, however\, the effect of these new obligations\, in the absence of effective sanction regimes\, may well turn out to widen\, rather than narrow\, the scope for discretionary\, exploitative corporate decisions. SUMMARY:The repatriation of cultural treasures from museums:  are there legal solutions?
DESCRIPTION:The past 20 years have brought a series of high-level requests for the repatriation of important treasures\, held in British museums\, to their countries of origin.  Latest polls show more than 50% of English public support returning the Parthenon Marbles to Greece.  The Horniman Museum has returned its collection of Benin Bronzes to Nigeria.  There are pending repatriation requests\, of various degrees of seriousness\, from Egypt\, India\, and Australia.  In other countries\, there have been repatriations based on long-term loans or indeed straight returns.  In this country\, it’s more complicated.  This event will discuss repatriation as a historical phenomenon in the context of museum collection development\, and as a political problem in the present\, and ask whether existing cultural heritage law has a significant role to play in untangling some of these problems. \nSpeaker:  Dr. Tatiana Flessas \nTatiana Flessas holds a BA in Philosophy from Wellesley College\, a JD from Northeastern University School of Law\, and an LLM and PhD from the London School of Economics.
