Their responses in past situations are important data points in evaluating regulatory regimes that might apply in the event of a CCP member default. The discussion will feature a review and analysis of the actions taken by key CCPs in the wake of high-profile defaults in the Lehman and MF Global cases\, including a review of the public customer account porting process and the portfolio auctions.  The discussion will also touch upon other member default situations and CCP reactions in those cases. \nThis event will be of interest to those with an interest in financial and insolvency law\, financial market infrastructure\, market regulation\, and banking law. Students are warmly encouraged to join. \nSpeaker: Vincent E. Lazar \n \nVince Lazar is co-chair of Jenner & Block’s Bankruptcy Litigation and Markets & Trading practices. Drawing upon his bankruptcy and restructuring expertise\, Vince regularly advises clearing organizations\, self-regulatory organizations and market participants concerning member default issues\, customer protection concerns and crypto and fintech proposals. \nVince has played a leading role in a number of financial services sector insolvency cases and is considered an expert on commodity broker bankruptcy cases. He represented the CME Group in the SIPA liquidation proceeding of MF Global\, including implementation of its unprecedented transfer of under-margined positions to other commodity brokers; the examiner in Lehman Brothers; both the National Futures Association and CME Group in Peregrine Financial Group’s case; the bankruptcy trustees in Stotler & Company and Refco\, LLC\, where he acted as the trustee’s special counsel in the first-ever successful bankruptcy sale of a commodity broker business; and trustee of Sentinel Management Group\,  a $1 billion+ fraud case involving the misuse of segregated customer assets. It argues that\, in contrast to traditional\, shareholder-oriented concepts of directors’ duties\, new stakeholder-oriented obligations have been established\, inter alia\, by new European legislation rooted in international standards. While far more detailed and prescriptive than traditional duties\, however\, the effect of these new obligations\, in the absence of effective sanction regimes\, may well turn out to widen\, rather than narrow\, the scope for discretionary\, exploitative corporate decisions. DESCRIPTION:The past 20 years have brought a series of high-level requests for the repatriation of important treasures\, held in British museums\, to their countries of origin.  Latest polls show more than 50% of English public support returning the Parthenon Marbles to Greece.  The Horniman Museum has returned its collection of Benin Bronzes to Nigeria.  There are pending repatriation requests\, of various degrees of seriousness\, from Egypt\, India\, and Australia.  In other countries\, there have been repatriations based on long-term loans or indeed straight returns.  In this country\, it’s more complicated.  This event will discuss repatriation as a historical phenomenon in the context of museum collection development\, and as a political problem in the present\, and ask whether existing cultural heritage law has a significant role to play in untangling some of these problems. \nSpeaker:  Dr. Tatiana Flessas \nTatiana Flessas holds a BA in Philosophy from Wellesley College\, a JD from Northeastern University School of Law\, and an LLM and PhD from the London School of Economics.
